1. Acceptance of Terms

By accessing or using the website, products, or services provided by Hubbletech Solutions ("Company"), a technology solutions provider based in Chennai, Tamil Nadu, India, you agree to be bound by these Terms of Service. If you do not agree, please refrain from using our services.

2. About the Company

Hubbletech Solutions is a Chennai-based technology company specialising in enterprise software solutions including CRM platforms and AI-powered educational tools. All services are designed, developed, and delivered from Tamil Nadu, India.

3. Services Offered

• Hubbletech CRM: A cloud-based customer relationship management platform offered via subscription or one-time license
• XtraSmart: An AI-powered educational platform for children (coming soon)
• Custom Solutions: Bespoke software development and consulting services

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised access or breach. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Payment Terms

• All prices are listed in Indian Rupees (INR) and are exclusive of applicable GST (18%)
• Subscription fees are billed annually in advance
• One-time license fees are due upon agreement execution
• Annual Maintenance Contracts (AMC) are billed separately on a yearly basis
• Payments can be made via bank transfer (NEFT/RTGS/IMPS), UPI, or cheque
• Late payments beyond 15 days may attract interest at 1.5% per month

6. Refund & Cancellation Policy

Subscriptions: You may cancel your subscription at any time. No refunds are provided for partially used subscription periods. Access continues until the end of the paid period.

One-Time License: One-time purchases are non-refundable once the software has been deployed or delivered. Refunds may be considered within 7 days of purchase if no deployment has occurred.

AMC: AMC fees are non-refundable once the maintenance period has commenced.

7. Intellectual Property

All software, content, designs, trademarks, logos, and materials on this website and within our products are the exclusive intellectual property of Hubbletech Solutions. Unauthorised reproduction, distribution, or modification is strictly prohibited under the Indian Copyright Act, 1957 and the Trade Marks Act, 1999.

8. License Grant

Subscription: We grant you a limited, non-exclusive, non-transferable right to access and use our SaaS products during the active subscription period.

One-Time License: We grant a perpetual, non-exclusive, non-transferable license to use the software for your internal business purposes, limited to the number of users purchased.

9. Service Level Agreement

• We target 99.5% uptime for hosted subscription services
• Scheduled maintenance will be notified 48 hours in advance
• Support is available via email during business hours (Mon–Sat, 9:00 AM – 6:00 PM IST)
• Critical issues for enterprise clients are addressed within 4 working hours

10. Limitation of Liability

To the maximum extent permitted by Indian law, Hubbletech Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our services. Our total cumulative liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Hubbletech Solutions, its directors, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

12. Termination

We may suspend or terminate your access to our services at any time for violation of these Terms, non-payment, or any illegal activity. Upon termination, your license to use our software ceases immediately. We will provide you a 30-day window to export your data before permanent deletion.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms shall first be attempted to be resolved through mutual negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual consent. The seat of arbitration shall be Chennai, Tamil Nadu, and proceedings shall be conducted in English.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, the courts at Chennai, Tamil Nadu shall have exclusive jurisdiction.

15. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of our services after modifications constitutes acceptance of the revised Terms. Material changes will be notified via email to registered users.
